1. The service
FoundByName is operated by Philippe Nicolas, entrepreneur individuel (French sole trader), 1 rue de Madrid, 67310 Wasselonne, France, SIREN 938 048 071. The full details are on our legal notice. We record what AI assistants answer when someone looks for a local business. We sell monthly plans built on those answers: a report, a page about your business in question-and-answer form, published on foundbyname.com, updates to your Google Business Profile when you give us access, listing checks, and a new measurement every week. What each plan includes, and what it costs, is on the pricing page.
We also sell a one-time page, paid once. You get the same page on foundbyname.com and its text, ready to paste on your own site. You also get a check of what ChatGPT says about you and a second report 30 days after you pay. If AI assistants cite directories in your city, we write a listing for each one, and you verify it yourself on that site. The page stays online for 12 months from the day you pay. After that, it stays online only if you renew it each year or have an active plan. We never bill that renewal automatically.
We work with one business per trade per ZIP code. Once a business has paid, we stop offering the service to other businesses in the same trade and ZIP code. We do not accept an order from any of them while the first business's page or plan is active.
2. What we never promise
Nobody controls what an AI assistant answers. We do not promise that an assistant will name your business, rank it anywhere, or send you customers. What you get is the work listed in your plan or included in your one-time page, and an honest measurement, including when it shows no change.
3. Your account
One account per business, created after payment with the email used at checkout. Keep your password to yourself; you are responsible for what happens under your login. Tell us at once if you think someone else has it.
4. Billing
- Prices are in US dollars. A monthly plan renews every month and a yearly plan every year, automatically, at the price shown on the pricing page, until you cancel. The plan price applies from the first month: there is no introductory price.
- A year paid up front costs ten months and covers twelve. Switching to yearly credits what you already paid for the month in progress.
- The one-time page is paid once and does not renew. If you are not happy with the work, tell us up to 30 days after your second report and we refund the full price.
- Payments are processed by Stripe. The charge appears as FOUNDBYNAME.COM on your statement.
- Cancel any time from your account, without writing to us. The period you already paid for stays active until its end; there is no refund for a partial period, except where the law requires one. When we refund, and how, is on the refunds and cancellation page.
- If a payment fails, we retry, then pause the service until it goes through. Published pages come down when a plan ends, except a one-time page during the 12 months you paid for.
- We may change prices with at least 30 days’ notice by email, sent to the address on your account. The new price applies from your next renewal after that notice, and you can cancel before it applies.
5. Free tests
From time to time we run free tests with a few businesses. What we publish about a test is agreed in writing with that business beforehand, and the business stays unnamed unless it asks to be named.
6. Your content and our work
You confirm that the facts you give us about your business are true and yours to publish, and you allow us to publish them on the page we build for you and to submit them to directories and AI assistants. The page, its text and its structure belong to FoundByName while your plan or your one-time page is active. You can reuse its text on your own site at any time, and keep it there after the service ends. Our reports, rankings and recorded answers are ours; you may share your own report freely.
7. Fair use
Do not use the service to publish false information, to impersonate another business, to scrape our data, or to disrupt it. We can close an account that does.
8. Liability
The service is provided as described, without other warranties. To the extent the law allows, our liability for any claim is limited to the amount you paid us in the three months before the claim, and we are not liable for indirect losses such as lost business.
9. Ending the agreement
You can cancel a plan at any time. We can end the service with 30 days’ notice, or at once if these terms are broken. If we end a one-time page before its 12 months are over and you have not broken these terms, we refund the part of the price that covers the months left. Sections 6 and 8 survive the end of the agreement.
10. Data protection
What we keep about you, and why, is in our privacy policy. When we handle data on your behalf rather than our own, our data processing agreement applies from your first payment, without a signature, and it names every company that helps us on the subprocessors page.
11. Law and contact
French law governs these terms, because that is where the business is registered. If we cannot settle a dispute between us, the courts of Strasbourg, France will hear it. Nothing here takes away a right you have under the law of your own country that cannot be set aside by contract.
